Terms of Service
These Terms of Service (hereinafter referred to as "these Terms") set forth the conditions for the provision of the services (hereinafter referred to as "the Services") provided by Seventh Data Inc. (hereinafter referred to as "the Company") on this website. Users (hereinafter referred to as "Users") shall use the Services in accordance with these Terms.
Article 1 (Application)
These Terms shall apply to all relationships between the User and the Company regarding the use of the Services.
In addition to these Terms, the Company may make various provisions (hereinafter referred to as "individual provisions") regarding the use of the Services. These individual provisions, regardless of their name, shall constitute a part of these Terms.
In the event of any inconsistency between these Terms and the individual provisions, the individual provisions shall prevail unless otherwise specified.
Article 2 (Download and Usage)
Users can download and use the Services without any registration. The Services are free to download and free to use forever. The Company does not ask for any money. If you like the app, please tell your friends about it and help them achieve their goals too.
Article 3 (Data Management)
All data created and managed within the app lives solely on the User's device. The Company does not have access to or knowledge of any data stored within the app. When the app is deleted from the device, all data associated with it will also be deleted. The Company is not responsible for any loss of data due to the deletion of the app or any other reason.
Article 4 (Prohibited Actions)
Users shall not engage in the following actions when using the Services:
- Actions that violate laws or public order and morals
- Actions related to criminal activity
- Actions that infringe on copyrights, trademarks, or other intellectual property rights contained in the Services
- Actions that destroy or interfere with the functionality of servers or networks of the Company, other Users, or third parties
- Commercial use of the information obtained through the Services
- Actions that could interfere with the operation of the Services
- Unauthorized access or attempts to do so
- Collecting or accumulating personal information about other Users
- Impersonating other Users
- Actions that cause disadvantage, damage, or discomfort to other Users, third parties, or the Company
- Actions of providing benefits directly or indirectly to antisocial forces in relation to the Company’s services
- Other actions that the Company deems inappropriate
Article 5 (Suspension of Provision of the Services, etc.)
The Company may suspend or stop the provision of all or part of the Services without prior notice to the User if it determines that any of the following reasons exist:
- When performing maintenance, inspection, or updating of the computer system related to the Services
- When it is difficult to provide the Services due to force majeure such as an earthquake, lightning, fire, power outage, or natural disaster
- When computers or communication lines stop due to an accident
- Other cases where the Company deems it difficult to provide the Services
The Company shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or stoppage of the provision of the Services.
Article 6 (Usage Restrictions)
The Company may, without prior notice, restrict the use of all or part of the Services if the User falls under any of the following:
- Violation of any provisions of these Terms
- Other cases where the Company deems the use of the Services inappropriate
The Company shall not be liable for any damages caused to Users due to the actions taken by the Company under this article. The Company has no access to user data and thus cannot manage, retrieve, or restore any data stored on the User's device.
Article 7 (Disclaimer of Warranties and Limitation of Liability)
The Company does not warrant that the Services are free of defects in fact or law (including defects, errors, bugs, infringement of rights, etc.).
The Company shall not be liable for any damages incurred by Users due to the use of the Services. However, if the contract between the Company and the User regarding the Services (including these Terms) is deemed a consumer contract under the Consumer Contract Act, this disclaimer shall not apply.
Even in the case specified in the proviso of the preceding paragraph, the Company shall not be liable for any special damages arising from special circumstances (including cases where the Company or the User foresaw or could have foreseen the occurrence of damages) among the damages caused to the User due to default or tort due to the Company’s negligence (excluding gross negligence).
The Company shall not be liable for any transactions, communications, or disputes arising between the User and other Users or third parties regarding the Services.
Article 8 (Changes to the Service Content, etc.)
The Company may change the content of the Services or discontinue the provision of the Services without notifying the User, and shall not be liable for any damages incurred by the User as a result.
Article 9 (Changes to the Terms of Service)
The Company may change these Terms at any time without notifying the User if it deems it necessary. If a User starts using the Services after these Terms have been changed, the User shall be deemed to have agreed to the changed Terms.
Article 10 (Handling of Personal Information)
The Company shall handle personal information obtained through the use of the Services appropriately in accordance with the Company’s Privacy Policy.
Article 11 (Notices or Communications)
Notices or communications between the User and the Company shall be made in the manner specified by the Company. Unless the User submits a change notification according to the method separately specified by the Company, the currently registered contact information shall be assumed to be valid and notices or communications shall be sent to that contact information, which shall be deemed to have reached the User at the time of transmission.
Article 12 (Prohibition of Transfer of Rights and Obligations)
The User may not transfer their status under the Service Usage Agreement or their rights or obligations under these Terms to a third party without the prior written consent of the Company.
Article 13 (Governing Law and Jurisdiction)
The governing law of these Terms shall be the laws of Japan. Regarding all disputes arising out of or in connection with these Terms, the Tokyo District Court shall be the exclusive jurisdiction court of the first instance.
